Warranty Terms and Limitations
The meanings of certain terms used in this document are defined as follows:
“Customer” refers to any individual, firm, or company that has purchased any product and/or service from Data Hidrolik Makina Sanayi A.Ş. “DATA” refers to Data Hidrolik Makina Sanayi A.Ş.
DATA provides a 2 (two) year warranty for all equipment used on private yachts, and a 1 (one) year warranty for all equipment used on commercial vessels/ships and charter yachts.
The warranty period commences as of the delivery date of the vessel and shall not exceed 30 (thirty) months from the date of purchase for equipment used on private yachts, and 18 (eighteen) months from the date of purchase for equipment used on commercial vessels and charter yachts. Exception: For electrical, electronic, and hydraulic equipment mounted on a DATA product or supplied as an integral part of a DATA product, the warranty period is limited to 12 (twelve) months from the date of purchase.
This warranty is subject to the conditions and limitations stated below.
The warranty shall be deemed void in the following cases:
- Neglect or failure in performing regular maintenance and servicing of the equipment.
- Improper servicing, repair, or maintenance of the products, or such actions being carried out by unauthorized personnel.
- Determination of the suitability of the product and materials for the intended application is the sole responsibility of the Customer; DATA bears no responsibility for product suitability.
- DATA shall not be held responsible for any accident, loss, damage, or complaint arising under the following conditions:
- Any damage to the product and/or the vessel/yacht resulting from improper installation.
- Misuse or incorrect operation of the product.
- Inappropriate or unstable electrical power supply.
- DATA shall not be responsible for dismantling or installation labor carried out outside Türkiye for products covered under warranty. Services provided by DATA or by personnel authorized by DATA shall be invoiced and collected based on the applicable service rates at the time, including travel, accommodation, and labor costs.
- During the warranty period, a product or any of its components shall be repaired free of charge or replaced, provided that it is sent to DATA or to a service point designated by DATA and that all warranty conditions are fulfilled.
- All shipping and transportation costs related to products or spare parts covered under warranty shall be borne by the Customer.
- Throughout the warranty period, the Customer is responsible for replacing faulty parts on the product with the replacement parts supplied under warranty as soon as possible. Any faulty part replaced under this scope shall become the property of DATA. The replaced faulty part must be returned to DATA or to a service point designated by DATA for inspection. If the faulty part does not reach DATA within 30 (thirty) days from the shipment date of the replacement part, DATA reserves the right to invoice the replacement part and the associated shipping costs. If, upon inspection, it is determined that the failure does not fall within the scope of warranty conditions, the replacement product or part, together with shipping costs, shall be invoiced to the Customer.
- DATA reserves the right to improve the design of its products and the materials used without being obliged to make any changes to products manufactured previously.
- DATA shall not be held responsible for any damage or issues that may occur to any vessel, boat, place of use, person, or other equipment as a result of the installation or use of its products.
- In the event of any warranty-related claim regarding your product, please apply to the nearest DATA service or sales point together with proof of purchase. DATA’s approval must be obtained prior to any repair.
- Replacement of any part under warranty for a product whose warranty period is still valid shall not extend the overall warranty period of the product. The warranty period for a replacement part supplied under warranty is limited to 6 (six) months from the date of shipment or until the expiration of the product’s original warranty period, whichever occurs later. For spare parts supplied for products whose warranty has expired, the warranty period shall not exceed 6 (six) months from the shipment date.
